HeartDog Trainer Toolboxes Terms and Conditions of Use

By accessing a Trainer’s Toolbox produced by HeartDog you are agreeing to be bound by these Terms and Conditions, and agree that you are responsible for compliance with any applicable local laws. The materials contained within the Trainer’s Toolbox are protected by applicable copyright and trade mark law.

Terms

Permission is granted to the purchaser to use the materials in the Trainer’s Toolbox for commercial purposes within their dog training business to support students in training their dogs with the following permissions.

Permitted use includes:

• a) providing viewing access to the video content for dog training students via a paid learning platform, (e.g. Zenler, Thinkific, Teachable, Kajabi), as unlisted or private links on your business YouTube channel, within a closed Facebook community group for your paying students.
• b) distribution of non-video learning resources to your dog training students, including but not limited to handouts, progress trackers, journals and lesson plans.
• c) Modification of the materials to include the purchaser’s logo, brand colours and alteration of written content to reflect the purchaser’s preferred regional spelling or language.
• d) Translation of the written materials into purchaser’s chosen language for use in training programs.
• e) Modification of the introductory slides of the videos to reflect purchaser’s branding.
• f) Addition of personalised voiceover to videos in their complete format, including translation into other languages.
• g) Use of materials in lead generation activities including but not limited to: webinars, challenges, workshops and ebook downloads as incentives to join your mailing list.
• h) Use of the materials as outlined above by one business per toolbox purchase. Multiple staff members working for the purchasing business may use the materials in coaching as long as activities are undertaken solely by that business. Individuals may not hold copies of materials for external use not relating to the purchasing business.
• i) Each business that purchases the toolbox will be permitted one login for the Toolbox Syllabus and one attendee for group coaching. If you require additional access please email [email protected] for assistance.

This is the grant of a license, not a transfer of title, and under this license you may not:

• a) distribute, provide download links or transfer video files to other individuals or businesses at any time
• b) provide free access to the materials to individuals not enrolled in your training programs
• c) use the video content (in their complete form or as shorter clips) outside of the format presented in the toolbox, including but not limited to: use in other projects, creation of additional learning materials or video tutorials, or other commercial or non commercial activities.
• d) sell access to or distribute the toolbox to other individuals or businesses for commercial use.
• e) transfer the materials to another person or 'mirror' the materials on any other server, with the exception of downloading a single copy of the toolbox for your own access to a local computer or cloud storage platform.
• f) in the case of companies who purchase access to the Trainer’s Toolbox, the right to use lies solely with the purchasing company. Use by individuals in activities outside of their employment are not permitted and it is the sole responsibility of the purchaser to ensure that upon employment termination access to the materials is severed and copied/downloaded materials are destroyed.
• g) Personalise the content for use in multiple businesses under a single purchase licence. Nor can content be given to contractors for use in external activities not relating to the purchasing business.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by the Company at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any copied/downloaded materials in your possession whether in electronic or printed format.

Disclaimer

The materials within the Trainer’s Toolbox are provided 'as is'. HeartDog makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, HeartDog does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials within the Trainer’s Toolbox.

Limitations

In no event shall the Company or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials within the Trainer’s Toolbox.

Revisions and Errata

The materials appearing in the Trainer’s Toolbox could include technical, typographical, or photographic errors. HeartDog may make changes to the materials contained within the Trainer’s Toolbox at any time without notice. HeartDog does not, however, make any commitment to update the materials.
